2012 Diamond Offshore Co. v. ATP Oil & Gas

In the United States District Court for the Southern District of Texas, Galveston Division, Judge Marvin Isgur presiding. The Firm represented Diamond Offshore Company in seeking to recover Overriding Royalty Payments due to Diamond Offshore from ATP Oil & Gas, a multi-billion dollar offshore oil exploration company that filed for bankruptcy in 2012.  After negotiating a complete recovery of the royalty payments, the Trustee’s preference and avoidance claims were dismissed.  The Firm also represented Diamond Offshore in claims asserted by certain services providers and materialmen seeking to impose a statutory lien on Diamond’s overriding royalty payments under the Louisiana Oil Well Lien Act.  The Firm obtained a dismissal of the lien claims asserted by the alleged lienholders and their appeal was dismissed by agreement.
